This Privacy Policy explains how X-Care collects, uses, processes, discloses, and protects information in connection with the Services.
This Privacy Policy (the “Policy”) describes how X-Care Technologies, LLC (“X-Care,” “we,” “us,” or “our”) collects, uses, processes, discloses, and protects information when you access or use the X-Care website located at x-care.ai (the “Site”), any mobile applications, connected devices, integrations, application programming interfaces (APIs), analytics platforms, or any related services, features, or functionality (collectively, the “Services”).
This Policy applies to all users of the Services and governs all data collected in connection with your use of the Services, including data collected through connected devices, third-party integrations, and automated technologies.
By accessing or using the Services, you acknowledge that you have read and understand this Policy.
For purposes of this Policy:
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, as defined under applicable law, including but not limited to the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”).
“Sensitive Personal Information” means Personal Information that is considered sensitive under applicable law, including but not limited to precise geolocation, financial information, or government identifiers.
“Device Data” means any data generated, collected, or transmitted by connected devices, sensors, or integrations, including without limitation environmental readings, telemetry, diagnostics, device identifiers, firmware versions, connectivity logs, and usage metrics.
“Processing” means any operation performed on data, including collection, storage, use, disclosure, analysis, or deletion.
We may collect the following categories of information, including but not limited to:
(a) Personal Information, such as name, email address, phone number, mailing address, account credentials, product registration and ownership information, communications with X-Care, and transactional or commercial information where applicable.
(b) Device and Sensor Data, including temperature, humidity, motion, environmental conditions, device identifiers, serial numbers, firmware versions, connectivity logs, diagnostic data, performance metrics, and usage telemetry.
(c) Usage and Technical Data, including Internet Protocol (IP) address, device type, operating system, browser type, pages viewed, features used, interaction patterns, dates and times of access, and referring or exit pages.
(d) Location and Proximity Data, including approximate geographic location such as zip code or region and Bluetooth-based proximity data used for device connectivity and functionality. We do not continuously track precise GPS location except where explicitly required for a specific feature and with appropriate consent. X-Care may, with your permission, collect a one-time approximate location at sign-up to help us provide weather-relevant alerts (e.g. "sudden humidity drop forecast for your area — consider checking your sensors"). This single location reading is stored on your account and is never updated continuously. You may decline this prompt; the app remains fully functional without it. If you designate one of your devices as a Bridge (an always-on hub that watches your sensors over Bluetooth), X-Care may store the approximate location of that Bridge device so you can later identify where a misplaced sensor was last seen. This information is only visible to you and is never shared with third parties. We use the system "When In Use" location permission only — X-Care never tracks your location in the background and never collects precise GPS coordinates while you are using other apps. You may revoke location access at any time from your device's Settings, and you may request deletion of stored location data by contacting support@x-care.ai or via the in-app "Delete my account" flow.
(e) Derived, Analytical, and Behavioral Data, including predictive analytics, recommendations, behavioral insights, usage patterns, aggregated datasets, and benchmarking metrics.
We collect information from a variety of sources, including directly from you when you provide information, automatically through your use of the Services, from connected devices and sensors, from third-party integrations and partners, and from service providers acting on our behalf.
We may process your information for the following purposes: to provide, operate, and maintain the Services; to monitor environmental and device conditions and deliver alerts and insights; to improve functionality, performance, and user experience; to develop new products, services, and features; to generate analytics, insights, and business intelligence; to train and improve algorithms, including machine learning and artificial intelligence systems; to communicate with you regarding the Services; and to comply with legal obligations and enforce our rights.
Where required by applicable law, we process Personal Information based on the performance of a contract with you, our legitimate business interests, compliance with legal obligations, or your consent, where required.
We may disclose your information to service providers, including vendors that provide hosting, infrastructure, data analytics, customer support, and security or monitoring services; to affiliates and business partners that collaborate with X-Care to provide or enhance the Services; in connection with mergers, acquisitions, financings, or sales of assets; and to legal or regulatory authorities in order to comply with lawful requests, enforce our rights, or protect the rights, property, or safety of X-Care, our users, or others.
X-Care may aggregate information across users, devices, and platforms; de-identify or anonymize Personal Information so that it can no longer reasonably identify an individual; and combine data across multiple brands, products, and partner ecosystems.
We may use such aggregated or de-identified data for any lawful purpose, including but not limited to analytics, benchmarking, product development, commercial insights, and machine learning or artificial intelligence applications.
X-Care does not sell Personal Information in the traditional sense of exchanging data for monetary consideration.
However, certain disclosures of information for analytics, advertising, or business purposes may be considered “sharing” under applicable law, including the CPRA. Where required by law, you have the right to opt out of such sharing.
We use cookies and similar technologies to operate and maintain the Services, analyze usage patterns, improve user experience, and support functionality. You may control cookies through your browser settings, although disabling cookies may affect functionality.
We retain Personal Information for as long as necessary to fulfill the purposes described in this Policy, comply with legal and regulatory obligations, resolve disputes, and enforce agreements. Retention periods may vary depending on the type of data, the context of processing, and applicable legal requirements.
Depending on your jurisdiction, you may have the right to request access to your Personal Information, deletion of your Personal Information, correction of inaccurate information, data portability, opt out of the sale or sharing of Personal Information, and limit the use of Sensitive Personal Information.
We will verify your identity before responding to requests and will respond within the timeframes required by applicable law. You may designate an authorized agent to submit requests on your behalf, subject to verification requirements.
We implement reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, use, disclosure, alteration, or destruction.
However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
The Services are intended for users who are at least sixteen (16) years of age. We do not knowingly collect Personal Information or Sensitive Personal Information from individuals under the age of sixteen (16).
If we become aware that we have inadvertently collected such information, we will delete such information from our records and take reasonable steps to prevent further collection.
If you are a parent or legal guardian and believe that your child has provided Personal Information without your consent, you may contact us to request deletion.
California residents under the age of eighteen (18) may request removal of publicly posted content, subject to applicable legal limitations.
Your information may be transferred to and processed in the United States or other jurisdictions where X-Care or its service providers operate. Where required, we implement appropriate safeguards to ensure that such transfers comply with applicable data protection laws.
We do not use Personal Information to make decisions that produce legal or similarly significant effects without appropriate safeguards and compliance with applicable law.
We may update this Policy from time to time. Changes will become effective upon posting. Your continued use of the Services constitutes acceptance of the updated Policy.
